These Terms of Service ("Terms") govern your use of https://bingeandparty.com (the "Website") and private theatre experiences, packages, and add-ons provided by Binge & Party at our venue in Hyderabad, Telangana ("Services"). By browsing the Website, submitting an enquiry, or completing a booking and payment, you agree to these Terms and to our Privacy Policy and Refund Policy as linked in the footer.

If you do not agree, do not use the Website or book our Services.

Description of the service

Binge & Party offers private theatre rooms for celebrations, screenings, and small groups. Unless a package states otherwise, you are responsible for bringing and logging into your own streaming or media accounts (for example Netflix, Prime Video, Hotstar, or similar) on compatible devices we provide or that you connect as permitted. We provide the space, equipment made available as part of your package, and venue support as described at booking.

Booking and eligibility

• You must provide accurate contact and booking details. You are responsible for ensuring your group size and add-ons match what you purchased.
• The person making the booking must be at least 18 years old or accompanied by a responsible adult who accepts these Terms on behalf of the group.
• Your confirmed slot includes setup and checkout windows as communicated in your confirmation. Late arrival does not extend the end time unless we agree in writing.

Content, OTT, and lawful use

You may only stream or display content you are legally entitled to access. Unauthorised or pirated content, adult content where it would disturb other patrons or breach platform rules, or any content that is illegal under Indian law is strictly prohibited. We may end your session without refund if you breach this section.

Venue rules and conduct

• Smoking, vaping, and consumption of alcohol or illegal substances are not permitted on our premises.
• Outside food and beverages may be restricted or subject to package rules communicated at booking; confetti, glitter, smoke devices, and similar items that are hard to clean or damage equipment may be prohibited.
• You must follow staff instructions relating to safety, noise, capacity, and use of shared areas.
• Children may be part of your group; any child-specific charges or policies in your package apply. Supervision of minors is your responsibility.

Equipment and property

Do not move, disconnect, or tamper with fixed AV equipment, wiring, or furniture beyond ordinary use. You are liable for repair or replacement costs for damage caused by you or your guests, including spills, misuse, or vandalism. We may charge a reasonable cleaning fee for exceptional mess beyond normal use.

Personal belongings

You are responsible for your valuables and devices. We are not liable for loss or theft of personal property left unattended.

Payments

Prices are as shown on the Website or as quoted in writing at the time of booking. Payment is due according to the checkout flow (for example full payment or deposit as offered). You authorise us and our payment partners to charge the selected method. Taxes and fees will be shown or explained where applicable.

Cancellations and refunds

Cancellations, refunds, rescheduling, no-shows, and related rules are governed by our Refund Policy. That policy is incorporated into these Terms by reference.

Third-party services

The Website may link to maps, social media, payment providers, or streaming platforms. Those services have their own terms and privacy policies. We are not responsible for outages, content restrictions, or account issues on third-party platforms.

Disclaimer and limitation of liability

To the fullest extent permitted by applicable law in India, the Services and Website are provided on an "as is" and "as available" basis. We do not warrant uninterrupted operation of third-party apps or internet connectivity. We are not liable for indirect, incidental, special, consequential, or punitive damages, or for loss of profits or data, except where such exclusion is not permitted by law. Our aggregate liability arising out of a booking is generally limited to the fees you paid for that booking, except for liability that cannot be limited by law (such as death or personal injury caused by our negligence, where applicable).

Indemnity

You agree to indemnify and hold harmless Binge & Party, its owners, and staff from claims, losses, or expenses (including reasonable legal fees) arising from your breach of these Terms, your content choices, or injury or damage caused by you or your guests, except to the extent caused by our gross negligence or wilful misconduct.

Force majeure

We are not liable for delay or failure to perform due to events beyond our reasonable control, including natural disasters, pandemics, strikes, power or internet outages affecting the venue, or government actions.

Governing law and disputes

These Terms are governed by the laws of India. Subject to mandatory consumer protections, courts at Hyderabad, Telangana shall have exclusive jurisdiction over disputes arising from these Terms or the Services.

Changes

We may update these Terms by posting a new version on the Website. The "Last Updated" date will change. Continued use of the Website or new bookings after changes constitutes acceptance of the revised Terms where permitted by law.
